$5 million awarded in wrongful death lawsuit

OSF St. Francis Healthcare Systems based in Peoria has agreed to a settlement of $5 million with the estate of Richard J. Berry of Streator relating to a wrongful death lawsuit stemming from Berry’s death in December, 2009.

Circuit Judge Joseph Hettel approved the settlement and dismissed the case this week.

On Dec. 16, 2009, Berry was driving his car north on Route 23 near the intersection of Route 17 about three miles south of Streator. The driver of a semi-trailer owned by the hospital, David DeFrance of Canton, was eastbound on Route 17 when he failed to stop at the intersection and struck Berry’s car, causing his death.
