Law Firm’s Organizational Form, Insolvency Affect Extent of Members’ Personal Liability

Wednesday, March 14, 2012 from ABA/BNA Lawyers' Manual on Professional Conduct™ By Joan C. Rogers CHICAGO—Law firms' switch to limited liability entities can give lawyers a false sense of security about their vicarious liability for claims arising from colleagues' conduct, according to a panel discussion March 2 at the 11th Annual Legal Malpractice & Risk Management Conference. In launching the panel on “How Limited Is Your Liability?” moderator Allison D. Rhodes joked darkly that the real topic was “how we get your house.” The speakers focused on a question of keen interest to lawyers everywhere: Under what circumstances can members of a...

Don’t Let Your Personal Injury Claim Slip and Fall This Winter

Winter slip and fall claims in Illinois could depend on whether the dangerous condition was naturally or unnaturally accumulated. December 30, 2011 /24-7PressRelease/ -- For the people of the Midwest, the change of seasons, from fall to winter, means the return of snow and outdoor activities such as snowshoeing, sledding and skiing. And, while snow can be picturesque and conjure images of hot chocolate and fireplaces, it also can have a dangerous side -- not all images of winter are idyllic. Along with snow, the return of winter also brings ice and the potential for slippery conditions. The risk of injuries from...

Self-inflicted car insurance wounds: I crashed into myself!

By Emmet Pierce Drivers often are their own worst enemies, causing car insurance claims and failing to recognize the things they could have done -- or not done -- to avoid them. Penny Gusner, consumer analyst for CarInsurance.com, says most car accidents can be avoided. A frequent cause of claims is driver distraction. With devices like GPS tools, BlackBerrys and iPhones competing for your attention, you may find yourself multi-tasking when you should be keeping your eyes and your mind on the road. "People are just inattentive nowadays, it seems," Gusner says. "They are texting when they get in their car. They are...

The Financial Times recently revealed that car insurance companies have lost £2 billion in 2010 thanks to the amount of personal injury claims rising. Some new customers taking out car insurance have had to pay 30% more for their insurance this year than last. In recent years the car insurance industry has been hit hard with claims for bodily injury soaring to new heights. The Royal Bank of Scotland alone has to put in reserves of around £390 million in their insurance business solely due to the amount of individuals making claims for injury in road traffic accidents. In the worst...

Toyota injury claims survive dismissal attempts

(Reuters) - A federal judge largely rejected Toyota Motor Corp's attempts to dismiss personal injury claims brought over sudden unintended acceleration, according to a tentative order posted on Wednesday. The personal injury cases are proceeding at the same time as a proposed consumer class action over economic loss suffered by people who purchased Toyota vehicles. Last month U.S. District Judge James Selna similarly kept intact the bulk of the economic loss case. Toyota claimed that the personal injury plaintiffs failed to offer specific allegations of an actual defect in their vehicles' electronic throttle control system. via Toyota injury claims survive dismissal attempts | Reuters....

Lawyer Lies, Part 2

Michael Helfand on 10.26.10 Every day this week I'm discussing a different lie told by attorneys in the Chicago area. Today's lie is: You can't fire me! While in the best scenario you'd never need to find a new attorney, I'm blown away by the number of lawyers who make their clients believe that they are stuck with them. It happens all of the time in workers' compensation and personal injury claims and often in criminal cases too. There is nothing that prevents you from getting a new attorney. In personal injury cases, if a lawsuit hasn't been filed, it's often as...
